Welcome to Bazu. These Terms of Service (“Terms”) govern your access to and use of the Bazu mobile application, website, and related services (collectively, the “Service”) provided by Bazu Technologies, LLC (“Bazu,” “we,” “us,” or “our”), a Florida limited liability company.
BY CREATING AN ACCOUNT OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS, OUR PRIVACY POLICY, AND OUR MEDICAL DISCLAIMER. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
These Terms include an agreement to resolve disputes by binding individual arbitration and a waiver of class actions (Section 14). Please read those sections carefully.
Bazu is a wellness and food-tracking app for sugar-conscious adults. It helps you log meals, rate foods, see estimates of how your food choices might affect your body, and build steadier eating habits.
Bazu is intended for general wellness purposes only. Bazu is not a medical device and is not designed or intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition.
Bazu does not measure your blood glucose. Any glucose values shown in the Service are algorithmic estimates generated from the meals you log and from research on healthy non-diabetic adults — not readings from your body. See Section 3 for the full Estimated Glucose Curve disclaimer.
You must be at least 18 years old to create an account or use the Service. By creating an account, you represent that you are 18 or older.
The Service is offered and intended for use only within the United States. By using the Service, you represent that you reside in the United States. We make no representation that the Service is appropriate or available for use in other locations.
You may use Bazu if you have Type 1 diabetes or another insulin-dependent form of diabetes. The Estimated Glucose Curve and related per-meal prediction features are automatically disabled on your account; the rest of Bazu — meal logging, food scanning, the Nutrition Score, nutrition tracking, and community features — remains available.
Bazu is not designed to manage insulin-dependent diabetes.
The wellness model that powers the Estimated Glucose Curve is built from data on non-diabetic adults and would not accurately reflect the glucose dynamics of an insulin-dependent body. During onboarding you are asked to self-report your diabetic status; selecting Type 1 disables the curve feature on your account from that point forward.
You agree that you will not misrepresent your diabetic status to enable the disabled features and that you will not rely on Bazu to make medication, insulin, or other treatment decisions for any form of diabetes.

THE ESTIMATED GLUCOSE CURVE IS AN ESTIMATE, NOT A MEASUREMENT.
The 24-hour curve you may see in the Service is an algorithmic projection. It is built from (a) the meals you log, (b) per-meal predictions derived from food macronutrients, glycemic index, and glycemic load, and (c) a baseline rhythm derived from peer-reviewed research on healthy non-diabetic adults. No part of the curve is a real-time reading of your blood glucose.
UNDER NO CIRCUMSTANCES SHOULD YOU USE THE ESTIMATED GLUCOSE CURVE — OR ANY OTHER OUTPUT OF THE SERVICE — TO CALCULATE INSULIN DOSES, DETERMINE BOLUS AMOUNTS, ADJUST MEDICATIONS, OR MAKE ANY OTHER MEDICAL OR TREATMENT DECISION.
Bazu is not a continuous glucose monitor (CGM) and does not replace one. If you use a CGM, you should follow the instructions provided with that device and any guidance from your healthcare provider. The Service may display data synced from a CGM via Apple HealthKit; that data is shown for tracking convenience only and does not constitute medical advice or a treatment recommendation.
THE SERVICE AND ITS CONTENT ARE PROVIDED FOR GENERAL WELLNESS AND INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, TREATMENT, OR RECOMMENDATION.
The Service is not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition, including diabetes, pre-diabetes, obesity, eating disorders, or metabolic disorders.
You agree that you will not use the Service to:

WE ARE NOT LIABLE FOR ANY HEALTH OUTCOMES RESULTING FROM YOUR USE OF THE SERVICE.
Parts of the Service rely on artificial intelligence, machine learning, and algorithmic models — including the meal parser that interprets your meal descriptions and photos, the per-meal glucose response prediction, the Estimated Glucose Curve baseline model, the Bazu Score, and other suggestions or insights (collectively, “AI Outputs”).
Because of the inherent limitations of artificial intelligence and probabilistic models, AI Outputs may at times be incomplete, inaccurate, biased, probabilistic in nature, or substantially similar to AI Outputs provided to other users. AI Outputs are not deterministic and may change over time as our models are updated.
AI OUTPUTS ARE PROVIDED FOR WELLNESS AND INFORMATIONAL PURPOSES ONLY. THEY DO NOT CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, TREATMENT, OR A PROFESSIONAL RECOMMENDATION OF ANY KIND, AND MUST NOT BE USED TO MAKE ANY TREATMENT OR DOSING DECISION.
You should always use your own judgment, and the judgment of your healthcare provider, before acting on anything the Service generates.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for personal, non-commercial purposes.
You agree not to:
The Service is for personal use only. Any commercial use, including resale, redistribution, or use in connection with another product, requires our prior written consent.
You retain ownership of the original data and content you create and submit to the Service (“User Content”), including meal descriptions, meal photos, ratings, notes, profile information, goals, and any health-related data you manually enter or sync from connected services.
By submitting User Content, you grant Bazu a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, reformat, and analyze your User Content for the purpose of operating, providing, securing, and improving the Service. This license includes the right to:
This license ends when you delete the underlying User Content or your account, except for de-identified, aggregated statistics that no longer identify you.

We may remove or restrict any User Content that violates these Terms or that, in our reasonable judgment, is harmful or objectionable, with or without notice.
Bazu offers a free tier with basic features and a paid subscription (“Bazu Plus”) that unlocks additional features. Specific Plus features may change over time.
Current Plus plans:
Prices may change over time. Changes will not affect an active subscription until its next renewal.
We may offer a free trial (typically 7 days) for new Plus subscribers. Trial eligibility is limited to one per user. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the rate you selected.
Plus subscriptions are billed in advance and automatically renew at the end of each billing period (monthly or yearly) at the then-current price, unless cancelled at least 24 hours before the end of the current period. The cost of renewal will be identified before purchase.
Plus subscriptions are processed through the Apple App Store and billed to your Apple ID account. You can manage or cancel your subscription at any time in your Apple ID settings (Settings > [your name] > Subscriptions > Bazu). Cancellation takes effect at the end of your current billing period; you keep Plus features until then.
Refunds for App Store subscriptions are handled by Apple and are subject to Apple App Store policies. To request a refund, contact Apple Support. We do not pro-rate charges for partial subscription periods, and we do not refund unused time when you delete your account or cancel.
Use of the Service obtained through the Apple App Store is also subject to Apple's standard end-user license agreement and Apple's App Store terms. Apple is not a party to these Terms, has no obligation to provide support or maintenance for the Service, and is not responsible for any claim relating to your use of the Service. Apple is, however, a third-party beneficiary of these Terms for the limited purpose of enforcing them against you with respect to your use of the Apple-distributed Service.
The Service and all of its content, features, and functionality — including software, text, graphics, logos, icons, images, audio, video, models, algorithms, scores, and design — are owned by Bazu Technologies, LLC or our licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.
“Bazu,” the Bazu logo, “Bazu Score,” and other product and service names used in the Service are trademarks of Bazu Technologies, LLC. You may not use these marks without our prior written permission.
If you send us feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that feedback for any purpose, without any obligation to you.
The Service may integrate with third-party services such as Apple Sign-In, Google Sign-In, Apple HealthKit, RevenueCat, and analytics providers. Your use of those services is governed by the applicable third party's own terms and privacy policy.
With your permission, the Service may read health data — including CGM glucose readings — from Apple HealthKit. We use HealthKit data solely to operate and improve the Service and do not use it for advertising or share it with third parties without your consent.
The Service may contain links to third-party websites or resources. We are not responsible for their availability, accuracy, or content, and we make no warranties about anything you find on them. Your interactions with third parties are at your own risk.
Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your information, and your Privacy Choices page explains the rights you have over your data. By using the Service, you agree that we may process your information as described in those policies.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND COMPLETENESS.

OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF:
You acknowledge that the disclaimers and limitations in this Section 12 reflect a reasonable allocation of risk between you and Bazu and are an essential basis on which we offer the Service. Some jurisdictions do not allow certain limitations on warranties or liability, so some of the limitations above may not apply to you in their entirety.
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Bazu Technologies, LLC and its members, officers, employees, contractors, and agents from and against any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
READ THIS SECTION CAREFULLY. IT REQUIRES YOU AND BAZU TO RESOLVE DISPUTES BY BINDING INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, EXCEPT AS DESCRIBED BELOW.
Before starting an arbitration or filing in small claims court, you agree to first send us a written notice describing the dispute to hello@withbazu.com and to give us sixty (60) days to attempt to resolve it informally.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally will be resolved through final and binding individual arbitration, administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this arbitration provision.
The arbitration will be conducted in English. The arbitrator may award the same individual relief a court could award and must follow these Terms. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.
Either party may bring an individual action in small claims court for disputes within that court's jurisdiction, in lieu of arbitration.
YOU AND BAZU AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class-action waiver is found unenforceable, the rest of Section 14 is null and void, but the remainder of these Terms will continue to apply.
You may opt out of this arbitration and class action waiver agreement within thirty (30) days of first accepting these Terms by sending a written opt-out notice to hello@withbazu.com that includes your full name, the email address on your account, and a clear statement that you wish to opt out of arbitration. If you opt out, Section 14 will not apply to you; the rest of these Terms (including Section 15) will continue to apply.
Any claim arising out of or relating to these Terms or the Service must be brought within one (1) year after the claim accrues. Otherwise, the claim is permanently barred.
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law principles. For any dispute not subject to arbitration (including the small-claims carve-out and any disputes for which a user has opted out under Section 14.5), you and Bazu agree to the exclusive jurisdiction of the federal and state courts located in Miami-Dade County, Florida.
You may stop using the Service at any time. You may delete your account through the “Delete Account” option in the app or by contacting us at hello@withbazu.com.
We may suspend or terminate your access to the Service, in whole or in part, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive conduct, or created a risk for Bazu or other users, or if required by law.
On termination:
Sections that by their nature should survive termination will survive, including Sections 3 (Estimated Glucose Curve), 4 (Medical and Wellness Disclaimer), 5 (AI and Algorithmic Outputs), 7 (User Content licenses you have granted), 9 (Intellectual Property), 12 (Disclaimers and Limitation of Liability), 13 (Indemnification), 14 (Dispute Resolution), and 15 (Governing Law).
We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date and notify you in the app or by email. Your continued use of the Service after the changes take effect means you accept the updated Terms. If you do not agree to the updated Terms, stop using the Service and delete your account.
These Terms, together with our Privacy Policy, Medical Disclaimer, and Your Privacy Choices page, constitute the entire agreement between you and Bazu regarding the Service and supersede any prior agreements.
If any provision of these Terms is found unenforceable, the rest of the Terms will remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
Our failure to enforce any right or provision in these Terms is not a waiver of that right or provision in the future.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.
Except for Apple Inc. as expressly provided in Section 8.7, these Terms do not create any third-party beneficiary rights.
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, pandemics, acts of war or terrorism, government actions, internet or telecommunications failures, or third-party service outages.
We may give you notices by email (to the address on your account) or through the Service. You give us notices by email to hello@withbazu.com.
These Terms are written in English. Any translation is provided for convenience only; in case of conflict, the English version controls.
